State Govt Employee Who Worked On Deputation In Central Govt Dept Not Entitled To Pension
The Supreme Court recently ruled that a state government employee serving on deputation in a central government department is not entitled to pension under the Central Civil Services (Pension) Rules, 1972.

The case involved a person who was appointed as Animal Husbandry Commissioner under the Government of India on deputation but remained a state employee.

The Calcutta High Court and Central Administrative Tribunal had earlier decided that his pension should be calculated under the central pay scale.

However, the Supreme Court disagreed, clarifying that deputation does not equate to permanent absorption into the borrowing department, and this person’s pension eligibility should remain governed by the West Bengal state pension rules.
