BREAKING || Residence-Based Reservation In PG Medical Courses Impermissible, Violates Article 14: SC
In a significant ruling, the Supreme Court has declared that domicile-based reservations in postgraduate (PG) medical courses are unconstitutional as they violate Article 14 (Right to Equality) of the Indian Constitution.

A bench comprising Justice Hrishikesh Roy, Justice Sudhanshu Dhulia, and Justice SVN Bhatti ruled that State quota PG medical seats must be filled based on merit in the Neet exam and not through residence-based reservations.

The Court reaffirmed its previous rulings in the Pradeep Jain and Saurabh Chandra cases, emphasizing that: India has only one domicile—every citizen has the right to reside and seek education anywhere in the country.

Domicile-based reservations are permissible only at the MBBS level, but not for PG courses due to the need for highly skilled medical professionals.

However, the Court clarified that this ruling will not affect students who have already secured admission under domicile reservations or those who have completed their PG medical courses.
