No Accident Claim Can be Granted Deceased Insured Person Not Holding Valid Driving License Uttarakhand State Commission (Consumer Case)
The complainant’s son, whose vehicle was insured with National Insurance Company, died in an accident, which also caused damage to the vehicle. The policy included a personal accident cover of Rs. 1,00,000.

After the accident, the complainant informed to insurer and submitted the necessary documents, but the company failed to honor the personal accident claim despite providing false assurances. After receiving no satisfactory response to a legal notice, the complainant filed a complaint with the consumer forum, seeking the personal accident claim amount.

The bench noted that the complainant’s son was driving with a learner’s license at the time of the accident, which violated Rule 3 of the Central Motor Vehicle Rules, 1989. This rule requires a valid license holder to accompany the learner and mandates the display of the letter “L” on the vehicle. Since these conditions were not met, there was a breach of both the rules and the policy terms. As a result, no compensation was awarded, and the appeal was dismissed.
