Rajasthan High Court Sets Aside A 14-Year-Old Order Demoting A Government Employee From A Post
The Rajasthan High Court recently overturned a 14-year-old demotion order against a government employee, who had served for 17 years in a promoted position.

The demotion was based on a passing reference in a previous case involving a counterpart, where the court had commented that the promotion was granted erroneously, but without discussing the petitioner’s specific case.

The Court ruled that the demotion, based solely on these observations, was unjustified, as the petitioner was not a party to the earlier case. The Court also pointed out that the demotion was barred by time, as the petitioner had served for nearly two decades. In its judgment, the Court quashed the demotion, directed the payment of all retirement benefits, and ensured the petitioner’s pension was calculated based on the higher position.
