SC Grants Custody Parole To Delhi Riots Accused Tahir Hussain For Delhi Elections Campaigning

The Supreme Court on 28th January granted custody parole to Mohammad Tahir Hussain, an undertrial in the 2020 Delhi riots case, to campaign in the upcoming Delhi Assembly elections.

Hussain, a candidate from the Mustafabad constituency representing AIMIM, will be allowed to canvass votes from January 29 to February 3 during day hours, as per jail manual rules. The parole comes with strict conditions.

Hussain must pay Rs. 2,07,429 in advance for two days’ security expenses, with subsequent payments due every two days. He is prohibited from visiting his house near Mustafabad, alleged to be the site of a criminal conspiracy, and must stay at an accommodation arranged by his counsel or a specified hotel. Additionally, he cannot comment publicly on the case.

The decision, made by a bench of Justices Vikram Nath, Sanjay Karol, and Sandeep Mehta, is specific to this case and will not serve as a precedent. The Court also clarified that the pending bail application in the High Court will be decided independently.

Hussain, a former Aam Aadmi Party (AAP) councilor, faces serious charges, including murder and conspiracy, linked to the death of IB officer Ankit Sharma during the riots. Despite opposition, the Court permitted custody parole, citing the election urgency.
