Supreme Court Delivers Split Verdict On Tahir Hussain’s Plea Seeking Interim Bail For Delhi Election
The Supreme Court delivered a split verdict on Wednesday in the plea of Tahir Hussain, accused in the 2020 Delhi riots case, seeking interim bail to campaign for the Delhi Assembly elections.

Justice Pankaj Mithal rejected the plea, while Justice Ahsanuddin Amanullah allowed it. The matter will now referred to the Chief Justice of India to decide whether it goes to a third judge or a larger bench.

Hussain, accused of the murder of IB staffer Ankit Sharma during the riots, had sought bail after the Delhi High Court denied him interim relief, granting only custody parole to file his nomination. Justice Mithal opposed granting bail, citing potential misuse and risks to witnesses, adding that campaigning doesn’t require physical presence and that the right to contest in elections is not a fundamental right.

Justice Amanullah, however, argued that Hussain has been in custody for five years, and the charges remain allegations at this stage. The prosecution opposed the plea, calling it a tactic to secure bail. They highlighted Hussain’s alleged role in the riots and pending cases under UAPA and PMLA. Hussain’s counsel countered, citing delays in the trial and his consistent custody, arguing for fairness under Article 21 of the Constitution. The case awaits further direction.
