Accused Cannot Claim Acquittal on Ground of Faulty Investigation: Supreme Court
The Supreme Court ruled that an accused cannot be acquitted simply due to a faulty investigation. It emphasized that defective investigations don’t automatically benefit the accused.

Courts must still consider other evidence, such as eyewitness testimonies and medical reports. In a case involving violent clashes between RSS and CPI(M) during a hartal, which led to two deaths, the accused were initially found guilty of several charges under the Indian Penal Code including murder.

While some were acquitted by the High Court, others appealed. Despite contradictions in some witness statements, the Court found the witness credible and dismissed the appeal, affirming the High Court’s decision.

The Court stressed that minor contradictions in testimonies do not automatically invalidate the entire case, and the investigation’s flaws should not be used to benefit the accused. The evidence was considered reliable, and the appeal was rejected.
