Consumer Case on Siyaram Silk Mills for the Extra Charge
Siyaram Silk Mills launched a ‘2+2’ promotional scheme where customers paid for two shirts and received two free. The complainant ordered four white shirts under this scheme, expecting to pay Rs. 2,000, but was charged an extra Rs. 50 for one shirt, bringing the total to Rs. 2,050.

Upon receiving the shirts, the complainant found that two were priced at Rs. 799 each, not the expected Rs. 999. Despite attempts to resolve the issue through a legal notice and showroom visits, the company failed to address the grievance.

The complainant filed a complaint, alleging misrepresentation, unfair trade practices, and deficiency in service. The District Commission with the case based on the complainant’s submissions, as no company representative appeared. The bench noted that the company failed to respond to the notice, effectively accepting the complainant’s allegations.

It found the company’s actions to be an unfair trade practice under Section 2(r)(1) of the Consumer Protection Act, 1986 and determined that the complainant suffered due to the company’s deficient services, causing mental agony and harassment. As a result, the commission allowed the complaint and directed the company to pay Rs. 400 with interest at 9%, along with Rs. 25,000 for mental pain, agony, and harassment.
